Terms of Service - TinyPod

1. Acceptance of Terms

By accessing or using Tinypod ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Tinypod provides fully managed hosting for open source applications. We deploy and manage containerized applications on your behalf on our infrastructure or your own servers (BYOVPS).

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to use the Service to:

Host illegal content or conduct illegal activities
Send spam or unsolicited communications
Mine cryptocurrency
Host content that infringes intellectual property rights
Attempt to gain unauthorized access to other systems
Distribute malware or malicious code
Host adult content without prior written approval
Conduct activities that violate applicable laws

5. Payment Terms

Subscription

Subscriptions are billed monthly at $5/server/month. Each server provides a fixed allocation of compute resources. You may add or remove servers at any time. You may cancel at any time, with access continuing until the end of the current billing period.

Bring Your Own VPS

BYOVPS is billed at $5/server/month. You are responsible for all costs associated with your own server. Tinypod charges only the platform fee. No per-app or resource limits apply.

6. Suspension and Termination

Payment failure

3 day grace period after failed payment
App suspended (not deleted) after grace period
App and data permanently deleted after 30 days of suspension

Cancellation

Apps continue running until end of billing period
Suspended 7 days after billing period ends
Permanently deleted 30 days after suspension

We reserve the right to suspend or terminate accounts that violate these terms without notice.

7. Data and Backups

We provide backups according to your plan:

Free: No backup
Starter: Weekly backup, 2 copies
Pro: Daily backup, 7 copies
Business: Daily backup, 30 copies + one-click restore

Backups are provided as a best-effort service. We recommend maintaining your own backups for critical data. We are not liable for data loss.

8. Uptime and Service Level

We target 99.9% uptime. Planned maintenance will be announced via our status page at status.tinypod.app. We are not liable for downtime caused by third-party providers, DDoS attacks, or force majeure events.

9. Intellectual Property

Tinypod and its original content are owned by Tinypod and protected by intellectual property laws. Open source applications deployed through Tinypod remain subject to their respective licenses.

10. Limitation of Liability

To the maximum extent permitted by law, Tinypod shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits.

11. Indemnification

You agree to indemnify and hold harmless Tinypod from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of India.
